DMCA Policy
Aleksandar Pavlovic Bayern ("we," "us," or "our") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), the text of which can be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond expeditiously to claims of copyright infringement committed using our service and/or our website (the "Site") if such claims are reported to our Designated Copyright Agent identified below.
This page describes the information that should be present in a DMCA Notice and a DMCA Counter-Notice. It is designed to make the process as straightforward as possible for both copyright holders and affected users.
Filing a DMCA Infringement Notice
If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Site by completing the following DMCA Notice of Alleged Infringement and delivering it to our Designated Copyright Agent.
Upon receipt of a valid DMCA Notice, we will take whatever action, in our sole discretion, it deems appropriate, including removal of the challenged material from the Site.
Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including attorneys' fees, incurred by the alleged infringer or by Aleksandar Pavlovic Bayern. For your complaint to be valid under the DMCA, you must provide the following information when providing notice of the claimed copyright infringement:
- An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright's interest.
- A description of the copyrighted work that you claim has been infringed, including the URL (i.e., web page address) of the location where the copyrighted work exists or a copy of the copyrighted work.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled and information reasonably sufficient to permit us to locate the material (e.g., the specific URL(s) of the infringing material).
- Your contact information, including your address, telephone number, and email address.
- A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
Counter-Notification Procedures
If you believe that material you posted on the Site was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us (a "Counter-Notice") by submitting written notification to our Designated Copyright Agent identified below.
Pursuant to the DMCA, the Counter-Notice must contain substantially the following:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled (e.g., the specific URL(s)).
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Aleksandar Pavlovic Bayern may be found, and that you will accept service of process from the person who provided notification of the alleged infringement.
Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity was removed or disabled by mistake or misidentification may be subject to liability for damages, including attorneys' fees, incurred by Aleksandar Pavlovic Bayern or the copyright owner. Filing a false Counter-Notice constitutes perjury.
Upon receipt of a valid Counter-Notice, we will promptly provide the complaining party with a copy of the Counter-Notice. Unless the copyright owner files an action seeking a court order against you within 10 business days of receiving the Counter-Notice, the removed material may be replaced, or access to it restored, in our sole discretion.
